India’s Enforcement Directorate (ED) has suffered repeated setbacks in some high-profile money laundering cases. What’s the reason? The Supreme Court ruled last year that regulators cannot rely solely on “criminal conspiracy” as a “predicate crime” to base a case. The offense should also fall within the ambit of the Prevention of Money Laundering Act (PMLA) schedule.
For context: “Predicate offense” refers to the nature of the offense mentioned in the primary First Information Report (FIR) registered by another agency, based on which the ED builds a case.
Some cases that failed due to reliance on criminal conspiracy as a predicate offence include the case against Karnataka deputy chief minister DK Shivakumar and another against a retired IAS officer who served under former Chhattisgarh minister Bhupesh Baghel case. Incidentally, both are senior Congress leaders.
